Flexible RE Company LLC ("we," "us," or "our") operates Vivy, a personal vacation assistant available as a mobile application and at vivy.ai (together, the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use the Service.
By using Vivy, you agree to the collection and use of information in accordance with this policy. If you do not agree, please do not use the Service.
1. Information We Collect
Information you provide directly
- Account information: Your name, email address, phone number, and authentication credentials when you create an account.
- Profile and preferences: Dietary restrictions, travel preferences, budget ranges, activity interests, daily routines, and other personal preferences you share with Vivy to personalize your experience.
- Trip data: Destinations, dates, itineraries, reservations, group member information, and other details related to trips you plan or participate in through the Service.
- Group member information: When you invite others to a trip, you may provide their names, phone numbers, and email addresses. We use this information solely to facilitate trip coordination at your direction.
- Communications: Messages you exchange with Vivy, including text-based conversations, voice call transcripts, and feedback you provide about recommendations.
- Payment information: If you purchase a subscription or trip package, we collect billing details through our payment processor. We do not store full credit card numbers on our servers.
Information collected automatically
- Device information: Device type, operating system, unique device identifiers, and mobile network information.
- Usage data: How you interact with the Service, including features used, screens viewed, actions taken, timestamps, and session duration.
- Location data: With your permission, we collect precise location data from your device to provide location-aware recommendations during active trips. See Section 6 for details.
- Log data: IP address, browser type, referring/exit pages, and crash reports.
2. How We Use Your Information
We use your information to:
- Provide, maintain, and improve the Service, including personalized trip planning and recommendations.
- Coordinate group trips by sharing relevant trip details among group members you designate.
- Send you trip-related communications, updates, and reminders via push notifications, SMS, or voice calls.
- Learn your preferences over time to deliver increasingly personalized experiences.
- Process transactions and send related information, including purchase confirmations.
- Send administrative messages, such as updates to our terms or policies.
- Detect, prevent, and address technical issues, fraud, or security concerns.
- Analyze usage patterns to improve the Service (in aggregate, de-identified form where possible).
3. How We Share Your Information
We do not sell your personal information. We share information only in the following circumstances:
- With your trip group: When you create or join a group trip, relevant trip details (itinerary, preferences, availability) are shared with other group members. Private preferences marked as "only Vivy knows" are never shared with group members.
- Service providers: We use third-party services to operate the Service, including cloud hosting, communication delivery (SMS, voice), analytics, error monitoring, and payment processing. These providers access your data only to perform services on our behalf and are contractually obligated to protect it.
- Legal requirements: We may disclose information if required by law, regulation, legal process, or governmental request.
- Business transfers: In connection with a merger, acquisition, or sale of assets, your information may be transferred. We will notify you before your information becomes subject to a different privacy policy.
- With your consent: We may share information for purposes not described here with your explicit consent.
4. Text Messages and Voice Calls
Vivy communicates with you and your trip group members via SMS text messages and voice calls to coordinate trips, deliver reminders, collect preferences, and provide real-time assistance.
- Consent: By providing your phone number and using the Service, you consent to receive text messages and voice calls from Vivy related to your trips and account. For group members you invite, Vivy will identify herself and the trip organizer when making contact.
- Message frequency: Message frequency varies based on your trip activity. You may receive several messages per day during active trip planning and travel, and infrequently at other times.
- Opt-out: You can opt out of text messages at any time by replying STOP to any message from Vivy. You can opt out of voice calls in the app's settings. Opting out of messages may limit Vivy's ability to coordinate your trips.
- Help: Reply HELP to any text message from Vivy for assistance, or contact us at hi@vivy.ai.
- Costs: Message and data rates may apply. Vivy does not charge for sending messages, but your carrier's standard messaging rates apply.
- Carriers: Supported carriers include all major US carriers. Carriers are not liable for delayed or undelivered messages.
5. AI and Automated Processing
Vivy uses artificial intelligence to plan trips, generate recommendations, coordinate groups, and communicate with you. Your conversations, preferences, and trip data are processed by AI systems to provide personalized assistance. AI-generated recommendations are suggestions — you always retain control over your trip decisions.
We use your interaction history to improve Vivy's understanding of your preferences over time. This data is associated with your account and is not used to train general-purpose AI models for other customers.
6. Location Data
Vivy requests access to your device's precise location when you have an active trip, to provide location-aware recommendations (such as nearby restaurants or real-time navigation suggestions). Location access is optional. You can grant or revoke it at any time through your device's settings. Vivy does not track your location when you do not have an active trip, and location data is not sold or shared with advertisers.
7. Data Retention
We retain your account information and trip data for as long as your account is active. Trip data is retained after trips end to enable Vivy's memory features (remembering your preferences and history for future trips). You can request deletion of your account and all associated data at any time (see Section 9).
When you delete your account, we delete or de-identify your personal information within 30 days, except where we are required to retain it by law or for legitimate business purposes (such as fraud prevention or resolving disputes).
8. Data Security
We implement industry-standard technical and organizational measures to protect your information, including encryption in transit (TLS) and at rest, access controls, and regular security assessments. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
9. Your Rights and Choices
Depending on your jurisdiction, you may have the following rights regarding your personal information:
- Access: Request a copy of the personal information we hold about you.
- Correction: Request correction of inaccurate personal information.
- Deletion: Request deletion of your account and personal information. You can delete your account directly in the app under Settings, or by emailing us.
- Portability: Request your data in a portable, machine-readable format.
- Opt-out of marketing: Unsubscribe from marketing emails using the link in any marketing email. Note that we will still send transactional and trip-related communications.
- Opt-out of SMS: Reply STOP to any text message.
- Location: Manage location permissions through your device settings at any time.

California residents
Under the California Consumer Privacy Act (CCPA/CPRA), California residents have additional rights, including the right to know what personal information is collected, the right to delete, the right to opt out of the sale of personal information (we do not sell personal information), and the right to non-discrimination for exercising your privacy rights. To submit a CCPA request, email hi@vivy.ai with the subject "CCPA Request."
10. Children's Privacy
The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it promptly. If you believe we may have collected information from a child under 13, please contact us at hi@vivy.ai.
Trip organizers may add children as named travelers on a trip (for example, to account for dietary needs or activity preferences). This information is provided by the parent or guardian, not collected from the child directly.
11. International Users
The Service is operated from the United States. If you access the Service from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country. By using the Service, you consent to this transfer.
12. Third-Party Links and Services
Vivy may link to or recommend third-party services (such as restaurants, hotels, or booking platforms). We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies.
13. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on this page with a revised "Last updated" date, and by sending you a notification through the app or email where appropriate. Your continued use of the Service after changes are posted constitutes acceptance of the updated policy.
